Generally if someone 'fake eats' but you're still hitting them it won't really work either. It's such a huge niche in PvP that I really don't think features should be balanced around it. You may not get to 'fake eat', but neither does your opponent. Fake eating is kind of a stupid thing anyways, I'd like different animations for drinking potions and eating food, since they are vastly different things.
Taking a risk in a fight is supposed to be a risk, as the name implies, it's not something that's meant to be safe. Someone could just save their specs and maul you down at any moment you decide to risk it, that's really got absolutely nothing to do with healing hitsplits.
Healing hitsplats are generally not a feature I think is important at all, it really just clarifies what is happenening and I think that's okay. Having visible numbers on the hp bar would do the same thing.
Then again what would I know, I'm not a pker.
